Notification of Intent to Apply for School Improvement Grant Waiver
The U.S. Department of Education has afforded Pennsylvania the opportunity to extend the waiver previously granted under section 421(b) of the General Education Provisions Act to extend the period of availability of the fiscal year 2009 School Improvement Grant (SIG) funds awarded under Section 1003(g) of the Elementary and Secondary Act of 1965 (ESEA), as amended, until September 30, 2014. This request to extend the waiver, submitted pursuant to section 9401(d)(2) of the ESEA, would permit the Pennsylvania Department of Education (PDE), in accordance with criteria the PDE develops, to identify and allow local education agencies with Cohort 1 SIG schools additional time to expend remaining FY09 SIG funds in those schools.
PDE seeks this extended waiver because some Pennsylvania LEAs have implemented educational programs that have greatly improved the opportunities for their students and have successfully initiated systems to turn around previously low achieving school. PDE believes that the additional time is in the public interest and will enable qualifying LEAs to ensure that their Cohort 1 schools are able to use remaining FY 2009 SIG funds to support continued full and effective implementation of selected SIG intervention models for one additional year.

|Monitoring/Consolidated Program Review|
Each Local Education Agency (LEA) will have a review of federal programs' compliance once in a three year cycle. The yearly monitoring cycle runs from January through May of each year. When an LEA is due for a review, they are required to complete a self-assessment online at: www.leaderservices.com/fedmonitor with an assigned username and password provided by the Division of Federal Programs (DFP).
The monitors conducting LEA reviews are typically retired administrators that are hired and trained by Division of Federal Programs staff. Monitors will use the self-assessments completed by the LEA to verify compliance of each federal program requirement for Titles I Part A, I Part D, IIA, III, VI, Fiscal and Ed-Flex Waivers. LEAs will have access to their final monitoring report which is also stored online at www.leaderservices.com/fedmonitor . It can be viewed and printed after logging in with the same assigned username/password. Monitoring cycles are also posted on DFP's web site at all times.
Under the Consolidated Monitoring Process, every LEA receiving federal funds will be monitored at least once every three years (with the exception of Philadelphia and Pittsburgh who are monitored annually).

|Federal (Ed-Flex) Waiver Program|
The Superintendent shall submit the application for federal waiver. The Superintendent may apply for a federal waiver to any provision of the Education Flexibility Partnership Act of 1999, if the waiver will enable the school district to improve its instructional program or operate in a more effective, efficient or economical manner. An application for a federal waiver shall not be construed to supersede or preempt any provisions noted in the Education Flexibility Partnership Act of 1999. It is the school district's responsibility to determine that implementation of the federal waiver will be consistent with the terms of any court order, collective bargaining agreement or contract by which the district is bound. The Pennsylvania Department of Education shall approve, disapprove or request modifications to the application. The Pennsylvania Department of Education shall notify the school district on the status of the application.
- An application for waiver must include the signature of the Superintendent and date signed.
- An application for waiver must include the Federal Program and section to be waived.
- An application for Title I waiver must include Selection of Schools pages. One page completed without the waiver and one page completed with the waiver.
- Additional pages can be used to provide explanations and descriptions for each section.
- Sections must be clearly identified and all pages must be numbered.
