CHANGES TO UNIFORM COMMERCIAL CODE (UCC) FORMS
EFFECTIVE JULY 1, 2013
Senate Bill 381 was signed into law on June 27, 2013 and will become effective on July 1, 2013. This legislation amends Article/Division 9 of the Uniform Commercial Code. The primary change for filers will be the required use of new UCC forms. The new forms all have a revision date of on or after April 20, 2011. The new forms will be available on the Department’s website and accepted for filing beginning July 1, 2013.
The UCC online filing system for electronic and bulk filers will be updated and available on July 1, 2013 and will conform to the new law. For filers submitting using online XML systems, no changes will be required to your current XML database. The Department’s system will automatically conform the old XML to the new layout.
The Department recommends that you seek legal assistance in reviewing Senate Bill 381 to determine how other changes may affect your institution or agency. In particular, the amendment to Article/Division 9 affects individual and organizational debtor names on UCC financing statements, as well as makes changes to the “Correction Statement” (which will become an “Information Statement”). There is no change in UCC filing fees, search logic or the functionality of the online searches.
